Legal Aid in Family Law, Private Practitioner Scheme
It is essential that a person seeking legal aid in family law matters is assessed by a law centre before being referred to a Private Practitioner. Applicants for legal services under the Civil Legal Aid Act, 1995 are required to satisfy a means test and other criteria as set down in the Act.
The Scheme will apply only in relation to persons who have been granted legal aid certificates issued by the Legal Aid Board for family law proceedings in the District Court regarding:
• maintenance (other than enforcement through the District Court clerk)
• custody / access
• guardianship
• domestic violence
The Civil Legal Aid Act 1995 provides that financial eligibility will be determined by reference to a person’s disposable income and, where appropriate, disposable capital. More information can be obtained from http://www.legalaidboard.ie/lab/publishing.nsf/Content/Financial_Eligibility
